Bookings
are made with Theme Park Holidays S.L. trading
as Vacation Villas and yourself.
1. Your
booking
Once
you have made a provisional reservation with us,
we require you to complete our booking form. This
must be signed by the first named person on the booking
form (the party leader), who must be at least 18
and authorised to make the booking on the basis of
these booking conditions by all the persons named
on the booking form. All correspondence is sent to
the party leader who is responsible to us for all
payments in respect of the booking.
On
receipt of the booking form and deposit as referred
to in clause 2 below, we will send written confirmation
of your reservation to you. Accommodation is reserved
only for the use of persons named on the confirmation
invoice, so please check this carefully, notifying
us immediately if any detail is incorrect.
2. Payment
A
deposit of 30% of the total of your accommodation
rental must be paid at the time of booking. If you
book within eight weeks of departure the full amount
is due immediately.
The
balance of your holiday cost is due not less than
eight weeks prior to departure. This date will be
shown on the confrimation invoice. If all payments
due are not paid in full and on time, we reserve
the right to treat your holiday as cancelled by you,
retain the deposit held and require you to pay the
cancellation charges as specified in clause 4.
3. Your
holiday accommodation
This
is reserved exclusively for the people named on the
confrimation invoice and no other persons whatsoever
are permitted to stay there unless this has been
agreed with us in writing and appropriate payments
made.
Local
communities expect certain standards of behaviour;
clients are required to observe them.
You
must vacate the property during the morning on the
day of departure to enable cleaning and preparation
to be completed prior to the arrival of new guests.
This is normally 10am but the exact timing will be
shown on your confirmation invoice.
Should
you be responsible for breakages, loss or damage
of any item at the property during your stay, a charge
will be made locally or on your return home to cover
the cost of replacement.
4. If
you cancel your holiday
If
you or any member of your party cancels the booking,
this must be done in writing by the party leader
and sent by registered post or fax. All cancellations
are subject to a charge payable by you. This is expressed
below as a percentage of the total accommodation
rental. Cancellation received before departure:

5. If
we change or cancel your holiday
It
is unlikely that we will have to make any changes
to your holiday, but occasionally circumstances beyond
our control might make it necessary to make changes
both before and after bookings have been confirmed.
If we have to change your accommodation for any reason,
we will always do our best to provide an alternative
of at least a similar or better standard to that
booked. If we have to make a significant change we
will tell you as soon as possible and if there is
time before departure, we will offer you the choice
of the following options:
(i)
accepting the changed arrangements, or
(ii) purchasing another available holiday from us with you paying or receiving
a refund in respect of any price difference, or
(iii) cancelling, in which case you will receive a full and quick refund
of all monies you have paid to us.
In
addition, wherever there is a major change to your
accommodation caused by anything other than a force
majeure (see below), we will pay compensation as
follows:-

Compensation
is per person on the booking form, excluding infants.
Important
note: Compensation will not be payable if we
are obliged by force majeure to change or cancel
your holiday. In these booking conditions, force
majeure means war, threat of war, riot, civil strife,
industrial dispute, terrorist activity, natural
or nuclear disaster, fire, flood, adverse weather
conditions or any other circumstances beyond our
control. Please note that we cannot be held liable
for loss of main services such as electricity or
water supplies, nor any actions taken in the vicinity
of your accommodation by any authority over whom
we have no control. Similarly, you should be aware
that there may be occasions when an advertised
facility is either modified or not available. Such
situations may be dictated by local circumstances,
necessity for maintenance (eg swimming pools),
unsuitable weather conditions and other circumstances
beyond our control. If we are advised of this,
we will endeavour to inform you in advance, but
cannot be held liable in such circumstances.
6. Insurance
We
consider travel insurance to be so essential that
it is a condition of booking that you have taken
out comprehensive insurance cover. Please read your
policy details carefully. It is your responsibility
to ensure that you have adequate cover.
7. If
you have a complaint
In
the unlikely event that you have a complaint whilst
on holiday, it is a legal requirement that you immediately
inform the relevant supplier (eg villa manager) who
will endeavour to put things right. If you are not
completely satisfied with the solution offered or
provided, you must immediately make this known in
writing to the villa manager. If you fail to follow
this simple procedure, your entitlement to compensation,
if any, will be reduced or cancelled because you
will not have taken reasonable steps to mitigate
your loss and we will not have been given a full
opportunity to investigate and rectify the problem.
